Federal Immigration Law

The Immigration and Nationality Act (INA) distinguishes between grounds of inadmissibility, which can prevent a person from receiving a visa or being admitted to the United States, and grounds of deportability, which can subject a person already admitted to removal. Inadmissibility may arise from health-related, immigration, employment, and other statutory grounds, while deportability may result from circumstances such as being inadmissible at entry, remaining in violation of law, or failing to maintain nonimmigrant status or comply with the conditions of admission.

Because immigration consequences frequently depend on a person’s complete history, current status, method of entry, family relationships, employment, prior applications, and interactions with immigration authorities, an experienced immigration lawyer should evaluate the entire matter before a client files an application, travels internationally, accepts employment, or responds to federal enforcement action.

Removal Defense and Immigration-Court Proceedings

Removal proceedings determine whether a noncitizen is inadmissible or deportable. Unless the INA specifies otherwise, proceedings before an immigration judge are the exclusive mechanism for determining admissibility and removal of a noncitizen. The government may charge any applicable statutory ground of inadmissibility or deportability in these proceedings.

Removal defense requires more than responding to the allegations in a charging document. Immigration counsel should assess the legal sufficiency of the charges, preserve available objections, identify any applications for relief or protection, prepare testimony and documentary evidence, and comply with court-specific procedural requirements. Once an attorney files the required notice of appearance in immigration court, that attorney becomes counsel of record. The attorney then must appear for the respondent, files documents on the respondent’s behalf, accepts service, and receives access to the record of proceedings.

Post-order consequences also require a thorough, individualized analysis. Federal law permits reinstatement of a prior removal order when the government determines that a person illegally reentered after removal or voluntary departure under an order of removal. The reinstated order generally is not subject to reopening or review under that provision, and the individual is generally barred from applying for relief under the INA. Early advice can therefore be crucial when a person has a prior order, receives immigration-court documents, is detained, or encounters federal immigration authorities.

In a system where eligibility rules, agency procedures, executive policies, and judicial decisions operate together, experienced counsel can be essential to protecting legal rights and pursuing the most appropriate path under current federal immigration law. Lasnetski Gihon Law is a trusted name in the realm of immigration services, known for our commitment to uphold the rights of those we represent.
