In Orlando, your case will be handled by the court with jurisdiction over the charged crime. In general, in Florida, county courts have jurisdiction over misdemeanor offenses and circuit courts have jurisdiction over felony offenses.
Under Florida law, county courts have limited jurisdiction as set by statute. In general, they hear cases involving traffic offenses and misdemeanor criminal offenses. We represent clients in the following county courts in the Orlando area:
Florida’s circuit courts are courts of “general jurisdiction.” This means that if a case cannot be heard in a different court, it will be handled here. In practice, state felonies are heard in Circuit Court. We represent clients in the following circuit courts in the Orlando area:
Appeals from Circuit Courts are generally heard by the relevant District Court of Appeal (each Circuit Court appeals to a specific District Court of Appeal). Since 2021, all criminal appeals from County Courts are now heard by the District Court of Appeal as well.
The Florida Supreme Court reviews certain appeals directly, including any case where the death penalty is imposed which is must review. It may also choose to review certain (but not all) decisions from the District Courts of Appeal, but it is not required to do so. Because of this, decisions from the District Courts of Appeal are often final.
